SOOKE BRAND SERIES PRODUCT LIMITED WARRANTY

Each product sold by Sooke, Inc. ("Sooke," "us," "we," or "our") comes with a Limited Warranty (as defined below) for the original retail purchaser. PROOF OF PRODUCT REGISTRATION AND ORIGINAL PURCHASE RECEIPT IS REQUIRED FOR VALID WARRANTY COVERAGE.

Warranty Coverage:

Frame, Fork, and Electronics: Free repair or replacement within one year from the date of delivery. Battery: Free repair or replacement within two years from the date of delivery or 500 charge cycles, whichever comes first.

This warranty only covers defects that existed at the time of delivery and applies to the battery, motor, controller, display, and sensors. Please note that the rechargeable battery pack will experience a decrease in capacity over time due to regular charging and discharging cycles. Sooke warrants that the battery pack will maintain a minimum of 70% capacity for at least 500 charge cycles or two years, whichever comes first. However, this warranty does not cover damage resulting from power surges, improper charging, water damage, improper maintenance, or normal wear and tear. The warranty is non-transferable and only applies to the original purchaser. No other remedy, such as compensation for damages or loss of use, is included in the warranty. The warranty period cannot be extended by offering additional coverage.

Remedies:

If the original retail purchaser discovers a warranty claim within the applicable warranty period, they must notify Sooke, an authorized dealer, or the retail location from where the product was purchased. Sooke will evaluate the warranty claim, and the purchaser must ship the product to the location designated by Sooke. If Sooke determines that the defective part is covered by the Limited Warranty, Sooke will, at its sole discretion, repair or replace the defective part at no cost to the purchaser and reimburse any shipping costs incurred by the purchaser. However, if the defective part is not covered by the Limited Warranty, Sooke will repair or replace the part at the purchaser's expense, and the purchaser will also be responsible for the shipping costs.

Requirements for this Limited Warranty to Apply:

To be eligible for warranty coverage, certain conditions must be met. Firstly, the original purchaser must provide proof of purchase from Sooke or one of its authorized dealers or distributors. Additionally, the warranty coverage is only applicable to the first owner who purchased the product from Sooke or its authorized dealers/distributors and is not transferable in case of resale. The product must have been used for its intended purpose and on paved roads as the Sooke product is designed for such use. Lastly, the electronics, connectors, and cables of the product must not have been altered, modified, or repaired by unauthorized personnel.

Exclusions:

This Limited Warranty does not cover the following:

(a) The product must have been purchased from Sooke or one of its authorized dealers or distributors, and the original purchaser must provide proof of purchase.

(b) The warranty only applies to the first owner of the product and is not transferable in case of resale.

(c) The product must have been used for its intended purpose and only on paved roads as it is designed for such use by Sooke.

(d) The electronics, connectors, and cables of the product must not have been altered, modified, or repaired by unauthorized personnel.

This Limited Warranty does not cover the following:

(a) Normal deterioration that occurs through regular use of the product.

(b) Damage or malfunction resulting from misuse, abuse, neglect, or accidents.

(c) Damage incurred during off-road or stunt riding, acrobatics, ramp jumping, or any other activity that deviates from the intended use of the product.

(d) Damage arising from improper battery charging or use of unauthorized chargers not provided by Sooke or its authorized dealers.

(e) Cosmetic damage such as paint scratches or rust.

(f) Installation of third-party parts, accessories, electrical, or mechanical components.

(g) Any parts that have been altered or interfered with, including but not limited to tires, brakes, chains, lights, motors, battery packs, displays, controllers, and so on.

(h) Damage resulting from commercial or rental use.

(i) Loss or damage of keys.

(j) Damage resulting from abusive treatment, racing, or stunt riding.

(k) Products with tampered serial numbers or bar codes.

Wear and Tear:

Over time, certain components of your Sooke product may wear down due to their function. The extent of wear and tear depends on factors such as the care and maintenance of the product, as well as the conditions in which it is used (e.g., mileage, climate, road conditions). Products that are frequently left outside may also experience increased wear and tear due to weathering. For safety reasons, it's important to replace these parts once they have reached their wear limit. This includes parts such as the drive chain or toothed belt, brake cables, brake pads, brake disc rotors, rubber hand grips, sprockets, pinions, or toothed belt discs, gear cables, tires, saddle cover, rims, and bearings in the headset, hubs, and bottom bracket.

The brake pads and disc rotors are especially prone towear due to their function. It's important to regularly check the condition of the pads and have them replaced by a specialist dealer if necessary. Brake disc rotors also wear out over time, and you should have the thickness of the brake disc rotors checked as part of regular inspections. If necessary, the components should be replaced. Please note that replacing these parts due to wear and tear is not covered by the statutory warranty.

Wear and tear on these moving parts is often caused by environmental factors, and it's important to regularly clean and maintain these areas. Depending on the operating conditions, it may be necessary to replace parts due to wear (for example, if bearing play starts to occur). If you need to arrange for repairs or replacement of parts, please contact your dealer to ensure the quickest and most cost-effective solution. You must follow shipping and disassembly instructions provided by the dealer or Sooke; otherwise, warranty service will not be provided. Failure to comply with assembly specifications and inspection intervals can also void the warranty and liability for defects. Please note that parts which must be replaced due to wear and tear are not covered under this Limited Warranty.

Other Limits to this Limited Warranty:

(a) Exclusivity of Warranty: This limited warranty is the full extent of Sooke's responsibilities and the customer's sole and exclusive remedy against Sooke, whether based upon warranty, statute, contract, tort (including negligence, strict liability, or any other theory of liability), indemnity, misrepresentation, or any other basis. This limited warranty is the sole warranty made by Sooke regarding the product and is in lieu of all other warranties, conditions, and remedies, whether written, oral, statutory, or implied, including but not limited to, the implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, and those arising by statute or otherwise in law or from the course of dealing or usage of trade. Sooke does not represent or warrant that the product (or any component thereof) will meet any or all of the customer's particular requirements. The customer acknowledges and accepts that any terms and conditions inconsistent with the terms of this limited warranty that may be contained or referred to in any standard terms and conditions of purchase of the customer (or any other document or writing produced by or on behalf of the customer, including without limitation, purchase orders, confirmations, and specifications) are expressly rejected and excluded. The customer further acknowledges that it is not relying on any statements, representations, or warranties made by any individual acting on behalf of Sooke as such individual, whether employee or agent, is not authorized to make statements, representations, or warranties that exceed those set forth in this limited warranty. Nothing in any assembly instruction, production information, or advertisements is intended to create or be construed as an express warranty of any kind with respect to the product. No agent, employee, dealer, representative, or reseller is authorized to modify or extend this limited warranty or to make binding representations or claims, whether in advertising, presentation, or otherwise. The limitations and disclaimers contained in this base warranty may not be modified, altered, or waived by any action, inaction, or representations, whether oral or in writing, except in writing signed by Sooke's duly authorized representative.

(b) LIMITATION OF LIABILITY: To the extent permitted by law, in no event will Sooke or its affiliates, or its and its affiliates' respective officers, directors, employees, licensors, manufacturers, or suppliers be liable to the customer, its parent, subsidiaries, affiliates, or customers or any third party for any loss of use, interruption of business, loss of revenue or profits, interest, lost goodwill, work stoppage, impairment of other goods, loss by reason of shutdown or non-operation, increased expenses of operation, cost of purchase of replacement parts or vehicles or claims by the customer or customer's customers for service operation or indirect, special, incidental, punitive, consequential, exemplary, aggravated, or reliance damages, however arising, whether for breach of warranty, contract, statute, tort (including negligence, strict liability, or any other theory of liability), misrepresentation, or otherwise, even if Sooke is made aware of the possibility of such damages.

Your rights may vary from state to state. Some states and jurisdictions do not allow limitations on how long an implied warranty lasts, or the disclaimer or limitation of incidental or consequential damages, so the above limitations and disclaimers may not apply to you, and they do not apply where prohibited by law.
